Youtube and Punk Kids
I've been seeing a lot in the news lately media corporations suing Youtube for copyright infringements, users uploading copyrighted material and distributing it. I've watched music videos and entire episodes of shows on Youtube, and I know that thousands of users violate copyright laws unbeknownst to Youtube. I wonder where the responsibility lies. The current law is that, if when Youtube finds the copyrighted material, it deletes it, it isn’t liable, but corporations such as Viacom and Fox are suing Youtube for the presence of their material on the site. So, the responsibility falls entirely with the companies who have material on the site to find it and notify Youtube. Though I definitely benefit from having illegally uploaded material on Youtube, from a strictly legal perspective, more liability should definitely fall with the person uploading the material.

I agree with you, the responsiblility definetly lies with the uploader of the material. YouTube is simply the host of all the uploaded videos and its policy protects it well enough. YouTube is not responible for the material that is posted (there's no way for them to be able to catch everything out of all the millions of videos posted up)and all companies can ask is that they be courteous enough to remove any copyrighted material when they come across, which is exactly what they do. From YouTube's perspective, they can only rely on people reporting the material and deal with it then. More liability should lie with the person uploading the videos but I don't think any serious legal action should be taken against offenders, maybe a slap on the wrist at first and then some sort of system of fines.
I also agree. The company cannot be held liable for the copyright material. It is said that this type of material is not able to be uploaded,so the person doing crime despite the warning is the only one that can really be held responsible.
There is no way that youtube would be able to filter through all the videos that violate copy right laws. The responsibility should definitely fall within the hands of the user. Other than that there isnt much that can be done unless each offender is tracked down and punished. Its a complicated situation.
